I have the honour to acknowledge the
21526 receipt of your Despatch No. 83 of the 7th. May last on the subject of the Trade Marks of Messrs. Arnhold Karberg & Co.

I enclose copies of two letters which have been received from Mr. H. E. Arnhold, dated the 26th. July,
and 4th. October, 1917, applying for the assignment to himself and his brother of the goodwill and marks of Messrs. Arnhold
Karberg & Co. in Hongkong.

If the goodwill and marks are in fact the property of Messrs. Arnhold, subject to the formal rights of the Custodian, it seems difficult to justify a refusal to assign the goodwill and marks to them, but it is probable that such an assignment would be extremely unpopular, especially
among trade competitors.

The marks in question may be said to con-
-sist of two parts, a picture and the name, the name being the Chinese name (Sui Kee) of the old firm of Arnhold Karberg & Co. The Arnholds would not use the old firm name (Sui Kee), but there is reason for thinking that in this and similar cases the picture and general get-up are more important than the name, and it is suggested that if these marks were agnin placed on the market by Messrs. Arnhold on impression might be
